New Zealand Arbitration Survey
“How many disputes are dealt with by arbitration in New Zealand? How many people work as arbitrators? What kinds of cases do they decide?” How could you possibly tell?
This survey is an attempt to answer these and other related questions about the practice of arbitration in New Zealand.
We are asking arbitrators to respond to the survey that follows. We very much appreciate the time taken to do so.
The responses will be used to produce a report with statistics about Arbitration in New Zealand between 2019 and 2020.
Once you click submit at the end of the survey, you will be redirected to a signup page where you can enter your email address to receive a copy of the report that we will be issued once the survey has been completed. Your responses will of course be treated entirely anonymously and the signup to receive the report will be recorded separately.
Some preliminary notes
We are interested in the number and kind of arbitrations undertaken in New Zealand. In order to gather the information, however, we need to ask some questions about the arbitrators. The survey is therefore in two parts.
The first part asks for some information about you, the arbitrator who is responding to the survey. Obviously, we only need that information once, so Part 1 of the survey only needs to be filled in once.
The second part of the survey asks questions about arbitrations you have been engaged in. We anticipate that some arbitrators will have been engaged in several different arbitrations. We therefore ask you to fill in that part of the survey for as many arbitrations as you have been engaged in during the relevant period.
We are only asking arbitrators to complete the survey. If you have been involved in an arbitration in any other capacity, we would be grateful if you could contact the arbitrator who was engaged to let them know that this survey is available. Please do not, however, answer the survey yourself. This is important to ensure that we get accurate data without double-ups.
Again, the survey is for arbitrators.
Please do not answer for any other adjudicative roles – for example, please do not answer for any expert determinations you may have done, or for work as a Construction Contracts Act adjudicator. If this survey is successful, we may set up surveys for those industries at a later date, but for now the only focus is arbitration.
We are surveying arbitrations that were commenced within the two-year period from 1 January 2019 to 31 December 2020. So:
- please DO NOT fill Part 2 of the survey in for any matter in which your appointment was before 1 January 2019, even if the substantive work of the arbitration took place after that;
- by the same token, please DO fill the survey in, even if the only thing that happened in the period was that you were appointed as arbitrator (and even if you were appointed on 31 December 2020)
