As the Appeal process is a confidential, we require your representative to sign the attached Confidentiality Agreement. Please arrange for your representative to sign the agreement and submit it with this notice if they have not already done so.

Note: Your representative cannot be involved unless they have completed and signed a Confidentiality Agreement.

As the appellant, you must pay the Appeal Panel’s Fee specified on this website, currently NZ$8,337.50 ($7,250.00 plus GST), before your appeal can commence.

Once your appeal is received we aim to assess and communicate whether your Appeal is accepted or declined. If accepted, and the Appeal Panel’s Fee has been paid, we will send your claim to the Respondent within five working days and request their response.

Once we receive the Respondent’s response, or after the response period has expired without a response, we aim to appoint the Appeal Panel within five working days. We will notify all parties once the appointment has been made.

In submitting this Appeal Notice, the Appellant confirms that they:

1. submit to the exclusive jurisdiction of the New Zealand courts with respect to any legal proceedings seeking to reverse the effect of a Determination requiring the suspension, cancellation, transfer or other amendment to a Domain Name registration, and agree that any such legal proceedings will be governed by New Zealand law; 
2. agree that their claims and remedies concerning the registration of the Domain Name, the Dispute, or the Dispute's resolution is solely against the Respondent; 
3. are not making the Appeal in bad faith, including that it is not for a dominant purpose other than resolving the issue of who the proper Domain Name Holder of a Domain Name is; 
4. agree to comply with the Scheme Rules and be bound by any resulting Determination, subject to any rights of review or appeal; 
5. acknowledge that if the Appeal Panel orders a transfer of the Domain Name to the Appellant:
   1. the Appellant will need to select an Authorised .nz Registrar to provide them with the necessary .nz registry and other services in respect of domain name, and they will advise Domain Name Commission (DNC) of their decision;
   2. that pending their selection of an Authorised .nz Registrar, the existing .nz Registrar of the Domain Names will continue to be the registrar of the Domain Names, and they will be deemed to have accepted that registrar’s existing terms; and
6. declare, to the best of their knowledge, the information contained in or attached to the Appeal Notice or otherwise comprising the Appeal is true and complete in all respects.
