Mark Colthart

Mark is a Commercial Barrister and Arbitrator specialising in commercial litigation, arbitration and construction law.

He graduated with a BA/LLB from the University of Canterbury in 1993, and was admitted as a Barrister & Solicitor of the High Court of New Zealand the following year.  In 2001 he completed an LLM (Honours) from the University of Auckland.  He has 18 years litigation and arbitration experience.

Mark is a member of Lorne Street Chambers, in Auckland.

Since being admitted to the bar in 1994 Mark has appeared in all of the major Courts in New Zealand, including as lead counsel in trials in the District and High Courts, and as counsel in appeals to the Court of Appeal and Supreme Court.  He has also appeared as counsel in numerous arbitrations, adjudications, and commercial mediations.

Mark has specialist experience in the areas of commercial litigation, property, and construction law.  As a commercial litigator he has represented some of New Zealand's leading companies in a wide range of commercial disputes. He regularly appears in the High Court in significant commercial litigation, including injunction and search order proceedings, shareholder disputes, contract and tort claims, and specific performance proceedings.

In the area of property and construction law Mark regularly advises and represents some of New Zealand's most significant property developers, construction companies, and other professionals in the building and construction industry. He regularly acts as counsel in arbitrations and adjudications, and advises parties on construction law and contractual issues.  He has also represented parties in numerous "leaky building" claims in the Courts and the Weathertight Homes Tribunal.

Mark is a Fellow of the Arbitrators and Mediators Institute of New Zealand (FAMINZ (Arb)), and a Fellow of the Chartered Institute of Arbitrators (London) (FCIARb).  He is an active member of the Society for Construction Law and the New Zealand Law Society. He sits as a member of the Auckland District Law Society Property Disputes Subcommittee.  He has presented widely on litigation, property and construction law issues.
